TERMS AND CONDITIONS OF MEMBERSHIP

Endorsed and Approved by SELDOC Council

GP’s are requested to please read the following:

1. SELDOC is a co-operative of general practitioners formed for the purpose of providing general medical services to patients outside normal working hours.

2. Membership of the co-operative is restricted to Principals in general medical practice registered with Lambeth, Southwark and Lewisham Health Authority. Any doctor who meets the criteria laid down by the JGPC and is eligible to work in General Practice, can, however, under a named Principal GP member, carry out sessions at SELDOC. Further information is available on request.

3. Each member shall be required to have current full registration with both the GMC and a Medical Defence Organisation. SELDOC reserves the right to inspect the original documents.

4. Each member agrees to indemnify SELDOC against any and all actions for medical negligence that may result from his/her acts or omissions whilst working for the co-operative. This condition applies particularly and specifically if the member’s personal medical negligence insurance has, for whatever the reason, lapsed.

5. SELDOC is a non-profit making company limited by the individual guarantee of £1 by each member of the co-operative. A member's maximum individual liability for the company is therefore limited to that amount.

6. The co-operative shall under no circumstances make a profit from its members. Sessional fees and service charges are to be used to share work and costs fairly and to ensure that each member's net contribution or deficit accurately reflects the amount of medical cover the co-operative provides for the member balanced against the amount of Sessional work he/she does for the co-operative.

7. The levels of all fees and charges are set so that as far as possible the co-operative shall either remain in balance or produce a [small] surplus in each year to create a general reserve for the continuation and development of the Co-operative.

8. The Sessional payments and service charges will be set at levels to enable, so far as is predictable, that the solvency of the co-operative is assured. Sessional payments and service charges will be reviewed at least annually, but could do so after any period of time. The Council will give a minimum of three months notice in writing to all members of any change in Sessional payments and/or service charges.

9. SELDOC GP members who receive more than three substantial patient complaints in a calendar year or a potentially serious patient complaint will be required to attend a meeting with the Board of Directors to address any concerns or issues. The findings of this meeting will be referred to the Council for further action if required.

10. SELDOC GP members, who have received a written complaint from another SELDOC GP member or a member of the SELDOC staff, may be required to attend a meeting with Board of Directors to address any concerns or issues. The findings of this meeting will be referred to the Council for further action if required.

11. A member leaving the co-operative shall give three months notice in writing, with the notice period to run from the first day of the month after receipt of notice of leaving.

12. Each member shall sign a direct debit mandate for the payment of all service charges, which will be debited from their account on or around the 13th of each month.

13. Any item of service claims, e.g. night visits fees, will remain the property of the practitioner with whom the patient is registered. Any item of service claims, or other fees relating to any patients who are not registered with a local practitioner will remain the property of the co-operative.

14. SELDOC will pay the doctor's gross Sessional payments monthly by direct credit into a bank account nominated by the member.

15. Each member shall be entitled to use the co-operatives on call service for all his/her out-of--hours work except for all planned inter-partum obstetric care, which is specifically excluded.

16. Members in an on-call Rota either within their own practice or those which may include other practices shall be entitled to use the Co-operative to cover their share of the Rota whether or not all other participants in the Rota are SELDOC members. This is provided that the member’s share of the Rota is always fair. The Board shall adjudicate on matters of fairness of the practice Rota and the decisions of the Board will be final and binding on all members concerned.

17. Members will be expected to respond to the needs of the Co-operative by offering to undertake a reasonable share of on-call Sessional work. The commitment should recognise the need to provide weekday and weekend cover and the need for seasonal flexibility in the Rota. The Board will decide the minimum number of sessions.

18. Subject to the above SELDOC will allocate Rota sessions to members in accordance with their requested preferences and in such a manner as to accommodate the wishes of as many members as possible.

19. The Board shall adjudicate on matters of fairness of the SELDOC Rota and their decision shall be final and binding on all members.

20. The Board will refer to the Council any member or Practice that consistently refuses to respond to all reasonable requests to support the SELDOC Rota. The Memoranda and Articles of Association [Article 7c] states that ‘a member shall cease to be a member immediately that he/she; in the view of the Council fails to adhere to the prevailing Terms and Conditions of Membership’. The Council has, therefore, the right to suspend service with one weeks notice to any member or Practice, so referred, pending further investigation. As a result of its investigation the Council will determine the need for, and outcome of, any further action, which may include termination of membership.

21. If and when a member is asked to leave or membership is terminated, SELDOC will give three months written notice with the notice period to run from the first day of the month after notice of leaving.

22. Membership refund can only be claimed within the last three months of the financial year concerned via written application.
